Terms of Use

These Terms of Use (“Terms”) govern your use of Headout (“the app”), a walking app developed by Tamas Bereczki (“we”, “us”, “our”). By downloading or using the app, you agree to these Terms and to our Privacy Policy.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to download and use Headout for your own non-commercial use on Apple devices you own or control, in accordance with the Apple Media Services Terms.

2. Walk safely — your responsibility

Headout sends you to walk to a location in the real world. You are solely responsible for your own safety and for your surroundings at all times. The checkpoint is a randomly chosen point and may not account for terrain, traffic, private property, weather, closures, or local conditions.

• Always obey traffic signals, road rules, signage, and the law.
• Watch where you’re going rather than your screen; stop before you read it.
• Do not enter unsafe, restricted, or private areas to reach a checkpoint — skip it and head out again.
• Use your own judgement about whether an area, route, or time of day is safe.

If a checkpoint would take you somewhere you shouldn’t go, end the adventure. No reward is worth your safety.

3. Health disclaimer

Headout is a motivation app, not a medical or fitness service, and does not provide medical advice. Distances, steps, and other figures are estimates for your interest only. Consult a qualified professional before starting any new physical activity if you have any doubt about your fitness to do so. You take part in any walk at your own risk.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law.
• Modify, cheat, or interfere with the app, its location detection, or its rewards — for example by spoofing your GPS location.
• Use the app for any unlawful purpose or in violation of any applicable rules.

5. Progress and rewards

Levels, XP, streaks, and any other in-app progress have no monetary value, cannot be exchanged for money, and may change as the app is updated.

6. Headout Pro and purchases

Headout is free to use. Headout Pro is an optional upgrade that unlocks additional walk modes, full statistics, and your complete walk history, offered as a monthly or yearly auto-renewing subscription or as a one-time lifetime purchase.

• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
• Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during that trial.
• You can manage or cancel a subscription in iOS Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
• Purchases are handled by Apple and are subject to the Apple Media Services Terms. Refunds are at Apple’s discretion; we cannot issue them.
• A lifetime purchase is a one-time payment that does not renew. “Lifetime” refers to the lifetime of the app and does not guarantee any particular future feature.

Prices are shown in the app in your local currency before you purchase.

7. Third-party services

The app relies on services provided by Apple — including Core Location, MapKit, and (where used) HealthKit and notifications. Your use of those services is also governed by Apple’s own terms and privacy policy. We are not responsible for the availability, accuracy, or performance of mapping, routing, or location data.

8. Disclaimer of warranties

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, always available, or that checkpoints, routes, or arrival detection will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, property loss, or loss of data, arising from your use of the app or from any walk you undertake. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

10. Changes to the app and these Terms

We may update, change, or discontinue the app or any of its features at any time. We may also update these Terms; material changes will be reflected by updating the effective date above. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Romania, without regard to conflict of law principles.
