Terms of Use

These terms cover your use of Moments: Daily Reflections (“the app”), a calm, private journaling app for iPhone developed by Tamas Bereczki (“we”, “us”, “our”). By downloading or using the app, you agree to them. They’re meant to be short and plain.

1. Your licence

We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, in line with the Apple Media Services Terms and these terms. The app and its design are ours; these terms don’t transfer any ownership to you.

2. Your content

The moments, notes, and custom activities you create are yours. They are stored on your device (and, where enabled, in your private iCloud). We never receive, read, or store them — see the Privacy Policy for details. You are responsible for keeping your own device and Apple Account secure, and for any backups.

3. A reflection tool, not medical advice

Moments is a personal well-being and journaling tool for noticing your own patterns. It is not a medical device and does not provide medical, psychological, or therapeutic advice, diagnosis, or treatment. Its insights are quiet, observational summaries of what you’ve logged — never clinical conclusions. If you are struggling or have health concerns, please speak with a qualified professional. In an emergency, contact your local emergency services.

4. Purchases

The current version of Moments is free. A future optional tier (“Moments Plus”) may add deeper, long-term features. Any such purchase would be processed by Apple through the App Store, and Apple’s refund and billing policies would apply. Nothing you have today will be taken away or placed behind a purchase.

5. Acceptable use

You agree not to:

• reverse engineer, decompile, or attempt to extract the app’s source code, except where the law expressly permits it;
• resell, redistribute, or sublicense the app; or
• use the app in any unlawful way or in violation of Apple’s terms.

6. Availability & changes

We may update, change, or discontinue features of the app over time. We aim to keep the core experience free and intact. We may also update these terms; material changes will be reflected by the effective date above.

7. Disclaimer & limitation of liability

The app is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the app. Nothing in these terms limits rights that cannot be limited under applicable consumer law.

8. Governing law

These terms are governed by the laws of Romania, without regard to conflict of law principles.
